Smart Contracts (ERC-721): Automating Royalties on the Secondary Market

How blockchain technology finally allows African artists to collect the resale rights due to them when their artworks are resold.

The history of contemporary African art is full of bitter stories. A young artist sells a promising painting for 500 euros in Abidjan or Lagos. Ten years later, the artist has become an international star. The same painting is resold at auction at Sotheby's or Christie's in London for 50,000 euros.

The collector who had a good nose cashes in a colossal capital gain. The artist, on the other hand, gets absolutely nothing.

In theory, a law exists to correct this injustice: the resale right (droit de suite). It stipulates that the artist (or their heirs) must receive a percentage (usually between 3% and 5%) on each resale of their artwork on the secondary market. In practice, this right is an administrative nightmare. It is almost impossible to enforce internationally, particularly for artists from the African continent who do not have the means to track sales in European or American galleries.

This is where Smart Contracts and the ERC-721 standard come in. By marrying copyright to computer code, the blockchain transforms an unenforceable legal promise into an inevitable mathematical execution.

1. Understanding the ERC-721 Standard

In the vocabulary of the blockchain, you often hear about NFTs (Non-Fungible Tokens). Behind this overused term lies a strict technical standard: ERC-721, used primarily on the Ethereum blockchain.

Unlike a banknote (fungible, a 10-euro note is identical to another 10-euro note), an ERC-721 token is unique. It has a specific identifier and cannot be divided. It acts as an indestructible digital certificate of authenticity.

When Ibeji Systems equips a physical painting with an NTAG 424 DNA cryptographic chip, we simultaneously create the "Digital Twin" of that painting in the form of an ERC-721 token. The owner of the physical artwork must hold the digital token in their wallet to prove they are the legitimate owner. If they sell the painting, they must transfer the token to the buyer.

2. The Smart Contract: Programmed Law

There is nothing magical about a Smart Contract. It is simply a small computer program, deployed on the blockchain, that executes automatically when certain conditions are met. If X happens, then do Y.

The major advantage of the blockchain is that, once the contract is deployed, no one (not the buyer, not the seller, not even the creator of the contract) can change the rules of the game. Code is law.

How to Automate the Resale Right?

At the moment the ERC-721 token (the artwork's certificate) is created, we integrate a mathematical clause into the Smart Contract:

"During each transfer of this token involving a financial transaction, 5% of the total sale amount must be instantly diverted and sent to the artist's wallet address."

The process unfolds as follows on the secondary market:

  1. Collector A wants to sell the painting to Collector B for 10,000 euros.
  2. The transaction takes place via an exchange platform connected to the Smart Contract. Collector B pays the 10,000 euros (in cryptocurrency or via a fiat/crypto bridge).
  3. At the exact moment the money leaves B's wallet to go to A, the Smart Contract intercepts the transaction.
  4. It calculates 5% (500 euros), sends it to the artist, and sends the rest (9,500 euros) to the seller. Simultaneously, the ERC-721 certificate is transferred to the new buyer.

All this happens in a few seconds, transparently, without lawyers, without copyright management societies, and without cross-border paperwork.

3. The Impact on the African Creative Economy

The integration of these technologies goes beyond simple protection; it restructures the very economy of creation.

A. Financial Sovereignty

African artists no longer need to wait for a Parisian or New York gallery to be willing (or not forget) to pay them their royalties six months after the sale. Payments are immediate, cross-border, and impossible to block by an intermediary. The artist gains true financial sovereignty.

B. Liquidity Financing Model

This technology also allows for novel financial arrangements. If an artist agrees to sell their first painting at a very low price to launch their career, they can configure the Smart Contract to take a 15% resale right on the next two resales. The artist becomes a shareholder in their own market value.

4. Current Challenges: Linking the Physical to the Digital

The system seems perfect, but there is a potential human flaw that the Meridian Artifact ID protocol solves: the grey market.

What happens if the two collectors decide to sell the painting to each other hand-to-hand, paying in cash, without transferring the ERC-721 digital certificate, to avoid paying the 5% royalties?

This is where hardware coupling comes in. If the new buyer possesses the physical canvas but does not have the associated digital token in their wallet, they will never be able to prove to an insurance company, a museum, or a future auction house that they are the legal owner. If they bring their phone close to the chip embedded in the canvas, the screen will indicate that the painting still belongs to the previous owner.

The value of an artwork in the 21st century is now intrinsically linked to the possession of its digital twin. The buyer is therefore forced to demand the transfer of the token (and thus trigger the Smart Contract and royalties) if they want to protect their investment.

Conclusion: Code Rather Than Compassion

For decades, the art world has relied on the goodwill and ethics of dealers to protect the economic interests of creators from the continent. The results have remained marginal.

ERC-721 Smart Contracts replace this random compassion with a relentless technical architecture. By guaranteeing artists that they will participate in the future success of their artworks, regardless of geography and intermediaries, this technology lays the foundations for an African art market that is finally equitable and financially sustainable.
